In the past I have just killed (force quit) espionagehelper in order to allow me to upgrade Espionage to the later version as it obviously gives the error that the file is in use otherwise.

Is there meant to be a better way of doing this?

Yes, the best way to update Espionage is to click Check for Updates in the Espionage menu.

The second best way to update is to trash your current copy of Espionage and move the new copy in and run it. It will force-quit the old helper for you.

Thanks. That would make sense. I guess I open the main Espionage app so rarely that I didn't even bother looking there. I guess this is one of those very few rare apps which you setup and then pretty much don't open again or much, rather just let it do its thing.
